The concurrence of crimes and continuation in the crime

Abstract:

Závěr a resumé Tato práce měla za úkol osvětlit pojmy souběh trestných činů, pokračování trestných činů a všechny jejich odnože a vůbec problematiku mnohosti v trestním právu z hlediska kvantitativního vrstvení jednání pachatelů trestné činnosti. Souběh jako jeden z mnoha pojmů trestního práva, jehož účinky ovlivňují jak samotný průběh trestního řízení, tak samotný osud pachatele trestného činu, zejména ve výměře trestu. Z těchto hledisek byl posouzen i další termín trestního práva a to pokračování trestného činu a jeho odnože trestný čin hromadný a trvající. Už v samotných názvech těchto veličin je ukryt hlavní rozdíl, který tkví právě v množství jednotlivých činů. U souběhu je hlavní položka mnohost činů, u pokračování jde o jeden trestný čin. Z tohoto důvodu byl rozebrán klíčový pojem: skutek. Proto se tato práce zabývala počtem skutků v jednání pachatele, který v zásadě určuje rozdíl mezi souběhem a pokračováním trestného činu a který je rozhodující pro průběh trestního řízení. Objasnila mechanismus trestání pachatelů trestných činů v případě souběhu a v případě pokračování trestného činu a vymezila rozdíly v posuzování tohoto výsledku trestního řízení. Byly popsány jednotlivé druhy souběhu od prakticky nepoužitelného a nepoužívaného jednočinného souběhu stejnorodého, jehož charakteristika téměř splývá s vlastnostmi trestného činu pokračujícího, přes vícečinný souběh stejnorodý a nestejnorodý, kde je důležité pojednání o skutku a výrazně se mění důležitost v jiných případech téměř sekundárních znaků jako jednotný záměr, blízkost časová a místní pro rozlišení od pokračování až po souběh jednočinný nestejnorodý, který je v praxi pro práci orgánů činných v trestním řízení z těchto hledisek nejzajímavější a zejména z níže uvedených a dalších právních důvodů nejsledovanější. Tato práce měla taktéž za cíl osvětlit pro praxi zejména v prvotním stadiu přípravného řízení paradoxně možná nejdůležitější vlastnost právního posouzení jednotlivých případů a to ve vyloučení souběhu. P Pro práci policisty (jako jsem třeba já) je však celý pojem souběh a nakonec i pokračování trestného činu jedním z malých a dá se říci nikterak stěžejních střípků celé mozaiky policejní práce jako takové. Je však důležitým pomocníkem ve světě, který se nazývá trestní právo, v dobrodružství, jakým je proplétání se labyrintem trestněprávní džungle a jako takový má jistě své pevné místo v této odnoži práva.

Abstract:

Conclusion and resume The main aim of this thesis was to explain terms for concurrence of crimes, continuation of crimes and all their types and the problems of plurality in Criminal Law from the point of view of quantitative stratification of behaviour of offenders, who committed criminal activity. Concurrence as one of the most frequent terms in Criminal Law, whose effects affect on one side the course of criminal procedure, but also the sole destiny of the crime offender, mainly in the stating the punishment. Another term of Criminal Law was evaluated from this point of view, i.e. continuation of crime and its types, multiple crime and persisting crime. There is hidden the main difference between these crimes already in names of these terms, which is in the number of particular crimes. The plurality of crimes is the main item in concurrence, but by continuation it is just only one crime. The following key term was analysed because of this reason: deed. Therefore this thesis was concerned with the number of deeds in offender's behaviour, which basically states the difference between crime concurrence and continuation, and which is decisive for the course of crime procedure. It made clear the mechanism of punishing offender s crime in case of concurrence and in case of continuation of a crime and it stated the difference in assessment of this crime procedure result. Separate types of concurrence were described from practically the unusable one to unused single acting homogenous concurrence, whose characteristics coincides with properties of continuing crime, through multi-acting homogeneous and heterogenous concurrence, where elaboration of deed is important and the importance of in many cases almost secondary traits significantly changes as uniform intentions, time and place affinity for the distinction between continuation up to the single acting heterogenous concurrence, which is the most interesting from the following criteria and the most watched from mainly below mention and other legal reasons, for the work practice of active authority in the crime procedure. This thesis had also the aim to clear up paradoxically mainly the most important property of legal assessment of separate cases, for practice mainly in the first stadium of preparatory procedure, which is the elimination of concurrence. For the work of policeman (such as me for example) is the term concurrence but also at the end of the day also the continuation of crime one of minor terms, one can say not really fundamental parts of the whole police work mosaic as such. However it is really an important helper in the world, which is called the Criminal Law, in the adventure, such as is weaving in and out through the maze called criminal jungle and as such has definitely its stable place in this part of law.
