Employment of Foreigners in the Czech Republic

Abstract:

Tato Diplomová práce se zabývá tématem zaměstnávání cizinců v České republice a zkoumá, kdo se v ČR považuje za cizince a jak jsou tito lidé kategorizováni s ohledem na možnost jejich pobytu a zaměstnání. Práce rozebírá právní požadavky, které musí zahraniční pracovníci a zaměstnavatelé splnit pro legální zaměstnání cizinců na území ČR. Zaměstnávání cizinců je regulováno zejména zákonem o zaměstnanosti a zákonem o pobytu cizinců, které musí dodržovat jak zaměstnavatelé, tak cizinci. Cílem práce je vymezit přístup k zaměstnávání cizinců na území České republiky, a to konkrétně občanů Evropské unie a občanů třetích zemí. Zároveň budou popsány způsoby pobytů cizinců na území České republiky a bude provedena komparační analýza rozdílu dodatečných časových a peněžních nákladů pro firmu zaměstnávající cizince v porovnání zaměstnávání pracovníků z České republiky prostřednictvím agentury. K teoretické části se váže praktická část, ve které jsou zpracovány data, které jsou čerpány ve vybrané výrobní firmě v Brně, která zaměstnává cizince z Ukrajiny a Filipín prostřednictvím agentury práce, ke zjištění konkrétních informací a porovnání časové a finanční náročnosti zaměstnávání ukrajinských nebo filipínských pracovníků ve srovnání s domácími pracovníky.

Abstract:

This thesis deals with the topic of employment of foreigners in the Czech Republic and examines who is considered a foreigner in the Czech Republic and how these people are categorised with regard to the possibility of their residence and employment. The thesis analyses the legal requirements that foreign workers and employers must meet in order to legally employ foreigners in the Czech Republic. The employment of foreigners is regulated mainly by the Employment Law and the Law on the Residence of Foreigners, which both employers and foreigners must comply with. The purpose of the thesis is to define the approach to the employment of foreigners in the Czech Republic, namely citizens of the European Union and citizens of third countries. At the same time, the methods of foreigners' stays in the Czech Republic will be described and a comparative analysis will be made of the difference in additional time and monetary costs for a company employing foreigners compared to employing workers from the Czech Republic through an agency. Linked to the theoretical part is the practical part, in which data are drawn from a manufacturing firm in Brno, which employs foreigners from Ukraine and the Philippines through an employment agency, to establish specific information and compare the time and financial intensity of employing Ukrainian or Filipino workers compared to domestic workers.
