Abstract:

Náhrada nákladů řízení vždy nerozlučně patří k občanskému soudnímu řízení. Vedení civilního procesu je totiž spojeno s náklady, které leží na straně účastníků řízení, ale také na straně státu. Z důvodu rozsáhlosti problematiky náhrady nákladů řízení se tato práce zaměří na oblast náhrady nákladů v občanském soudním řízení sporném, a to z pohledu prvoinstančního soudu, neboť v případě odvolacího a dovolacího řízení platí ustanovení o náhradě nákladů před soudem prvního stupně obdobně. Cílem práce tak bylo poskytnutí komplexního pohledu na náhradu nákladů v nalézacím řízení, jelikož odborná literatura na toto téma je dle mého názoru velmi rozptýlená a orientace v ní je tak pro neodborného čtenáře komplikovanou.

Abstract:

Reimbursement of legal costs is always an inseparable part of civil legal proceedings. Conducting a civil process is associated with costs that lie on the side of the parties to the proceedings, but also on the side of the state. Due to the extensiveness of the issue of reimbursement of legal costs, this work will focus on the area of reimbursement of costs in disputed civil court proceedings, from the point of view of the court of first instance, since in the case of appeal and appellate proceedings, the reimbursement of costs before the court of first instance applies similarly. The goal of the thesis was to provide a comprehensive view of reimbursement of costs in legal proceedings, as the professional literature on this topic is, in my opinion, very scattered and orientation in it is complicated for the non-expert reader.
