Modern patent management as an area of conflict between legal protection and economic significance: Design of a simple and effective patent circumvention algorithm

Abstract:

Dnešní moderní management patentů se zaměřuje na ochranu duševního vlastnictvía ekonomické nutnosti chráněných „unique selling propositions“. Nejen kvůlineustále rostoucí konkurence v globálním prostředí, ale také kvůli vývoji nákladůna získávání patentů, často patentů vlastních,je tato oblast stále významnějšíz mikro- i makroekoomického pohledu.Existuje mnoho metodických přístupů a inovativních metod získávání patentů.Žádná ze současných metod však není účinná pro skutečné inovativní řešení problémůa obecně nepomáhají ani při navrhování nových řešení, protože využívajíhlavně již dostupné patentové dokumenty. Tyto dokumenty poskytují užitečné informace,které lze převést do jiných oblastí a použít k řešení dalších technickýchproblémů. Aktuální patenty jsou tedy využívány ke zdokonalení výrobků nebo kezlepšování procesu získávání patentové ochrany nápadů, čímž se lze vyhnoutzbytečnému plýtvání zdroji a snížit náklady na výzkum a vývoj.Obecně je získávání patentové ochrany složitý postup a vyžaduje speciální metodologiia vysokou odbornost v oblasti vynálezu. Známé a zavedené metody inovací,jako je TRIZ (teorie vynalézavého řešení problémů), ARIZ (algoritmus pro systematickéobjevování) nebo LOGOS (inovace zaměřená na logiku a strategie duševníhovlastnictví), v souvislosti s posuzováním patentového prostředí a trhu mohou pomocinajít inovativní řešení pro získávání patentů.Ale protože TRIZ a další odvozené metody jsou také obecně velmi rozsáhlé a složité,aby prolomily patentové bariéry, je třeba vytvořit metodiku inovačního procesu.Cílem metodiky, která je prezentována v této práci, je odvodit, zjednodušit a zkombinovatznámé, jednorozměrné postupy do holistické, vícerozměrné, jednoduché abezpečné metody nazvané TRILOG Algoritmus. Algoritmus je postaven na čtyřechsloupcích (analýza, dekompozice, racionalizace a syntéza).V důsledku ekonomického významu ochrany duševního vlastnictví bude tlak nazavedení takovýchto holistických metod pro generování nového duševního vlastnictvínadále stoupat. Přínos zde prezentovaného algoritmu TRILOG v této souvislostiprokáže jeho budoucí uplatnění.V každém případě se v budoucnosti systém řízení, ale ani právo, nebudou moci intenzivnězabývat patentovým systémem a integrovat ho do výuky na univerzitách.Protože problémy a jejich řešení jsou vždy založeny na přirozeném principu akce areakce, a protože algoritmus TRILOG používá tento princip, mohl by být algoritmustaké vhodným nástrojem pro zcela jiné aplikace v budoucnosti. V upravené podoběby mohl být také použit v jiných oblastech řízení inovací nebo řízení podniků jakoprostředek k řešení problémů nebo jako nástroj strategického řízení.

Abstract:

Today, modern patent management varies between the protection of own intellectualproperty (IP) and the economic necessity of protected unique selling propositions.This is not only due to the steadily increasing competition in the global environmentbut also because the cost of the development of legal patent circumventions,even of own patents, is becoming increasingly crucial and gains importance inmicro- and macroeconomic.There are many methodical approaches and innovative design methods for patentcircumventions. But all current methods are not effective for real innovativeproblem-solving and generally, they are also not helpful in the design of new solutionsas they primarily utilise already available patent documents.In general, a legal and successful patent circumvention is a complex procedureand requires a special methodology in addition to a high level of expertise in the fieldof the invention. Known and established methods of innovation such as TRIZ (theoryof the inventive problem solution), ARIZ (algorithm for systematic invention) orLOGOS (Logic- oriented innovation and intellectual property strategy) in connectionwith the consideration of the patent environment and the market can help identifyinnovative solutions for patent circumventions. However, TRIZ and derived innovationmethods are both extensive and complex. Therefore, it seems reasonable to developa method that uses the advantages of established methods and simultaneouslyeradicates their application problems. This method, here introduced as the TRILOGalgorithm, derives, simplifies and recombines one-dimensional procedures to a holistic,multi- dimensional, simple and safe method. The algorithm is built on four columns(analysis, decomposition, trimming and synthesis). The TRILOG is applied tothree practical use cases. The described case studies illustrate how the TRILOG isconducted and how it can efficiently and effectively lead to the required results. Themain conclusions of the case studies are as follows: (1) the most important step fora successful patent circumvention is the determination of the state of art; (2) in general,the TRILOG is suitable for generating a new patent application based on patentcircumvention and therefore meets its main objective; (3) the TRILOG can be appliedin different fields and is not limited to one particular application field; (4) theTRILOG is more easily applied than established methods since it is a holistic stepby-step-approach which can be used by inexperienced operators; (5) notwithstandingthe previous statement, it is beneficial to dispose over expertise, in particularafter the second phase of the TRILOG.Due to the economic significance of IP rights the pressure for the establishmentof such holistic methods to generate new IP will continue to increase. The role of thehere presented TRILOG algorithm in this context will be shown in future.
