Abstract:

Bakalářská práce s názvem „Ozbrojené složky státu a soukromé bezpečnostní firmy: Partneři nebo konkurenti“ se zabývá problematikou soukromých bezpečnostních společností a jejich vztahem s ozbrojenými silami. V úvodu jsou definovány důležité pojmy z oblasti soukromých bezpečnostních společností, je zde popsán jejich vývoj od historie až po jejich současné postavení. Dále se práce obecně zaměřuje mezinárodně – právní dokumenty upravující činnost soukromých bezpečnostních společností a představuje právní regulaci na národní úrovni a tím poukazuje na rozdílnost právní regulace SVBS v jednotlivých státech. Zmíněna zde bude také Česká republika, kde zároveň upozorňuje na zcela nedostatečnou právní úpravu SBS. Tato část také poukazuje na USA, jakožto největšího najímatele soukromých vojenských a bezpečnostních společností. Praktická část práce se zaměřuje na rozbor a analýzu různých aspektů spolupráce soukromých vojenských a bezpečnostních společností s ozbrojenými složkami. Analyzuje konkrétní mezinárodně - právní dokumenty upravující činnost SVBS a poukazuje na jejich problematické aspekty. Kromě toho rozebírá také poskytovanou činnost, hlavní motivy a konkrétní případy jejich spolupráce. K výzkumu je použita kompilační metoda, tedy sběr informací z různých dokumentů, a jejich následná analýza na základě které se na základě získaných informací snaží porovnat vztah těchto dvou subjektů ve smyslu „partneři, či konkurenti“ a navrhnout možnou cestu legální spolupráce SVBS.

Abstract:

The bachelor thesis titled "State Armed Forces and Private Security Companies: Partners or Competitors" addresses the issue of private security companies and their relationship with the armed forces. The introduction defines important terms in the field of private security companies and describes their development from history to their current position. Furthermore, the thesis focuses on an international-legal level, presenting legal regulations at the national level and highlighting the differences in legal regulation of private security companies in different states. The thesis also mentions the Czech Republic, where it draws attention to the completely inadequate legal regulation of private security companies. This part also points out the United States as the largest employer of private military and security companies. The practical part of the thesis focuses on the analysis of various aspects of the cooperation between private military and security companies and the armed forces. It analyzes specific international-legal documents regulating the activities of private military and security companies and points out their problematic aspects. In addition, it analyzes the activities provided, the main motives, and specific cases of cooperation. The compilation method is used for research, which involves gathering information from various documents and analyzing them based on which the relationship between these two entities is compared in terms of "partners or competitors," and a possible way of legal cooperation is proposed.
