Mediation - An Effective Way of Dispute Resolution

Abstract:

Tématem této bakalářské práce je mediace jako jedna z cest řešení sporu. Úvodní část pojednává o konfliktu jako vyústění komunikačního nedorozumění, jeho příčinách, druzích, vývoji a řešení. V další části bakalářské práce stručně popisuji historii mediace v České republice, definuji pojem mediace, oblasti jejího uplatnění a zabývám se mediačním procesem. Třetí část věnuji osobě mediátora, jeho roli a požadavkům k výkonu práce mediátora. V praktické části porovnávám výsledky dotazníkového šetření, jehož záměrem bylo zjištění názorů a postojů veřejnosti k mediaci a konfliktům obecně.

Abstract:

The topic of this thesis is mediation as one of the ways of dispute solution. The introductory part deals with a conflict as the result of misunderstanding in communication, its causes, types, progression and solution. In the next part of the thesis I briefly describe the history of mediation in the Czech Republic, I define the concept of mediation, areas of its application and deal with the mediation process. The third part is devoted to the mediator?s person and role, and requirements for performance of mediator?s job. In the practical part, I compare the results of questionnaire survey the aim of which was to identify opinions on and attitude of the public to mediation and conflicts in general.
