Abstract:

Bakalářská práce je zaměřena na téma finanční a bankovní záruky. Zabývá se historickým vývojem bankovních garancí v České republice od roku 1964 do současnosti, přijetím nového občanského zákoníku a zánikem obchodního zákoníku. Cílem práce je přiblížit čtenáři pojem finanční a bankovní záruka, seznámit ho se základními principy a změnami v souvislosti se vznikem nového občanského zákoníku a analyzovat právní úpravu finanční záruky v tomto předpisu. Teoretická část definuje význam bankovní a finanční záruky a srovnává její právní úpravu v obchodním zákoníku a novém občanském zákoníku. Praktická část pojednává o jednotlivých typech záruk v České republice, převážně v oblasti stavebnictví, a zdůrazňuje vedle právních aspektů také ekonomický význam finanční záruky. Ten je doložen přehledy, které se týkají let 2012 a 2013 v oblasti veřejných zakázek v České republice.

Abstract:

The thesis is focused on financial and bank guarantees. It follows up the historical progression of bank guarantees in the Czech Republic since 1964 until present day and at the same time also the adoption of the new Civil Code and expiration of the Commercial Code. The objective is to familiarize the reader with the term financial and bank guarantee and to apprise him of the basic principles and changes resulting from adoption of the new Civil Code.The theoretic part explains the institute of the bank and financial guarantee and compares the original legislation (former Commercial Code) with the current concept captured in the new Civil Code and analyze the legal regulation of the financial guarantee in this regulation.The practical part introduces individual types of guarantees used in the Czech Republic, primarily on the field of the building industry, and emphasizes, besides the legal aspects, also their economic importance. It is demonstrated by surveys which concern the years 2012 and 2013 on the field of the public procurement in the Czech Republic.
