Work Obstacles on the Side of Employer

Abstract:

Tématem této bakalářské práce jsou překážky v práci na straně zaměstnavatele. Zde jsem se zaměřila na různé druhy pracovních překážek ze strany zaměstnavatele v rámci soukromé a státní sféry a jejich možné následky a případný dopad na zaměstnance. V teoretické části se zabývám z dostupných publikací a pramenů teorií jednotlivých kapitol, které budou směřovat k praktické části bakalářské práce. V praktické části jsem analyzovala konkrétní kolektivní smlouvy 13 státních a soukromých firem v České republice a vybrané judikáty Nejvyššího soudu, zaměřené na ustanovení §§ 207 až 210 zákona č.262/2006 Sb., ZPr, ve znění pozdějších předpisů, které se zabývají jednotlivými pracovními překážkami. Dále v praktické části porovnávám, rozdílnost přístupu ve státní a v soukromé sféře, jak zaměstnavatel řeší následky překážek v práci. V závěru bakalářské práce je obsažena analýza a porovnání přístupu zaměstnavatelů, působících jak ve státní, tak i soukromé sféře k překážkám v práci na jejich straně.

Abstract:

The thesis deals with the work obstacles on behalf of employer. The focus is on the different work obstacles on behalf of employer within private and state sector and their consequences and a possible impact on an employee. In the theoretical part I analyzed of the paper available publications and theories are being described and specific chapters were chosen to be analyzed in the practical part. In the practical part the focus is on the specific collective agreements of 13 state and private companies in the Czech Republic and chosen judicatures of the Supreme Court focusing on provision 207 - 210 Law n.262/2006 Sb., Labour Code, as amended which deals with work obstacles. In this part also differences between state and private sector are being compare the disparity in approach and as well as how employer solves the consequences of the obstacles. In the end of the thesis analysis and compared attitude of employers , working at both the state and the private sector to obstacles at work on their side.
