Personal data protection in the EU and the right to be forgotten

Abstract:

The diploma thesis deals with personal data protection in the European Union, that currently has been largely discussed topic because of adoption of the General Data Protection Regulation 2016/679. It applies from May 2018 and will replace the Directive 95/46/EC, that has been the core of legal regulation of data protection in the EU for more than twenty years. The so called Right to be Forgotten became a part of the new Regulation 2016/679, on the basis of which individual, under certain conditions, can request for deleting of his personal data. The right has become connected with Costeja vs. Google Spain judgment of the Court of Justice of the European Union from May 2014. By this judgment the CJEU granted individuals with right to ask search engines to delete their personal data from search results after entering their name into it. The judgment has become commented as the expression of the Right to be Forgotten on the internet. At first, thesis will deal with personal data protection within the EU, specifically with its history, development and circumstances that influenced the process. The goal is to offer clear and comprehensive view on this complex field, with understanding of mutual interconnections. Secondly, the thesis will deal with implementation of the Right to be Forgotten in the context of Costeja vs. Google Spain judgment in Czech Republic by using single-case study method. Attention will be paid on institutions, which are included into implementation of the right in Czech Republic and their current practice with its application.

Abstract:

Diplomová práca sa venuje ochrane osobných údajov v Európskej únii, ktorá je v súčasnosti veľmi aktuálnou a diskutovanou oblasťou v súvislosti s prijatím všeobecného nariadenia 2016/679, ktoré nadobudne účinnosť v máji 2018 a nahradí tak smernicu 95/46/ES, ktorá vyše dvadsať rokov predstavovala základ zákonnej regulácie problematiky ochrany osobných údajov v EÚ. Súčasťou spomenutého nariadenia sa stalo aj ustanovenie o práve byť zabudnutý, na základe ktorého môže subjekt údajov pri splnení určitých podmienok požiadať správcu o vymazanie osobných údajov. S premietnutím tohto práva do reality je najviac spájaný a akcentovaný rozsudok veľkého senátu Súdneho dvora EÚ vo veci Costeja vs. Google Spain z mája 2014. SDEÚ týmto rozsudkom priznal jednotlivcom právo požadovať po internetovom vyhľadávači odstránenie určitých odkazov z výsledkov vyhľadávania pri zadaní ich mena. Rozsudok býva komentovaný ako prvok a prejav práva byť zabudnutý v prostredí internetu. Autorka sa v predloženej práci bude zaoberať jednak ochranou osobných údajov v EÚ, konkrétne jej vývojom o okolnostiam, ktoré ho ovplyvňovali. Cieľom je prehľadné, zrozumiteľné a ucelené zobrazenie komplexnej problematiky ochrany osobných údajov v EÚ s pochopením vzájomných súvislostí. Druhá časť práce sa bude venovať implementácii práva byť zabudnutý v kontexte rozsudku Costeja vs. Google Spain v Českej republike s využitím metódy jednoprípadovej štúdie. Pozornosť bude venovaná aktérom, ktorí sú do implementácie práva v Českej republike zahrnutí, a ich doterajšej praxi pri jeho aplikácii.
