Abstract:

Diplomová práce se zabývá veřejnými strážemi. Na úvod si klade za úkol vymezit obsah tohoto pojmu a jejich postavení a funkce v systému veřejné správy. Krátce popíše jejich historii. Poté se bude věnovat platné právní úpravě v České republice – zmíní ústavní východiska a provede její podrobný rozbor včetně souvislostí s jinými odvětvími práva. Poté bude provedena komparace s právní úpravou Rakouské republiky a Slovenské republiky. Úroveň platné české právní úpravy bude průběžně hodnocena. V závěru práce bude pohledem de lege ferenda naznačeno, jak by zjištěné nedostatky mohly být napraveny a jakým směrem by se dále právní úprava veřejných stráží v České republice mohla ubírat.

Abstract:

This thesis is dealing with public guards. In introduction its aim is to define this concept as well as their position and function in the system of public administration. Their history is described briefly. After that it will deal with legislation in the Czech Republic. The thesis will mention the constitutional basis and will perform detailed analysis, including its connection with other branches of law. Then the comparison with the legislation of Austria and Slovakia will be done. The level of valid Czech legislation will be continuously evaluated. In conclusion, by the view of de lege ferenda will be indicated how to remove the deficiencies and which direction should go the legal regulation of public guards in the Czech Republic.
