Roman law influences in the legal practice of the city of Brno. Analysis of medieval and early modern legal sentences for Uherské Hradiště

Abstract:

Proslulá Právní kniha notáře Jana z pol. 14. století na první pohled zaujme výrazně romanizovaným obsahem, čímž se odlišuje od většiny dobových právních památek domácí provenience. Tato skutečnost pak přirozeně nabádá k otázce, do jaké míry a zda vůbec se jednotlivé, v Právní knize obsažené římskoprávní regule mohly promítnout do brněnské aplikační praxe. Cílem předkládané disertační práce je tuto otázku alespoň částečně zodpovědět, a to na příkladu středověkých a raně novověkých právních naučení určených Uherskému Hradišti. Pramenná základna právněhistorického a romanistického rozboru sestává z dochovaných uherskohradišťských městských knih (Liber negotiorum civitatis Hradisch a Liber informationum et sententiarum) a jejich pozdějších redakcí. První známá redakce Liber informationum et sententiarum je dnes uložena v Brně a byla dokončena roku 1543. Druhá redakce byla pořízena pro potřeby města Havlíčkův Brod o rok později. Vlastnímu rozboru předchází tři kapitoly, které s ústředním tématem disertace úzce souvisí. V jejich rámci autorka sleduje jednak stav a tendence dosavadních bádání v oblasti brněnského městského práva a správy do r. 1620. Následuje výklad o pramenech právní povahy, které ve sledovaném období tvořily legislativní rámec města Brna. Zvláštní pozornost přitom je věnována římskému právu, které v Brně mělo plnit subsidiární roli. Třetí kapitola se pak snaží objasnit významové roviny pojmu „právní naučení“ a zamýšlí se nad právní závazností výroků brněnských přísežných.

Abstract:

The famous Law Book of Jan the notary from the middle of the 14th century impresses at first glance with its significantly Romanized content, which distinguishes it from most contemporary legal monuments of domestic provenance. This fact naturally prompts the question to what extent and whether the individual rules of Roman law contained in the Law Book could be reflected in the application practice in Brno. The aim of the presented dissertation is to at least partially answer this question, using the example of medieval and early modern legal sentences for Uherské Hradiště. The source base of the analysis consists of the preserved municipal books of Uherské Hradiště (Liber negotiorum civitatis Hradisch and Liber informationum et sententiarum) and its later redactions. The first known redaction of the Liber informationum et sententiarum is today stored in Brno and was completed in 1543. The second redaction was taken for the needs of the city of Havlíčkův Brod a year later. The analysis is preceded by three chapters that are closely related to the central topic of the dissertation. In their framework, the author traces the state and tendencies of research to date in the area of Brno municipal law and administration up to the year 1620. This is followed by an explanation of the sources of a legal nature that formed the legislative framework of the city of Brno in the period under review. Special attention is paid to Roman law, which was supposed to fulfill a subsidiary role in Brno. The third chapter then tries to clarify the meaning of the term "legal sentence" and reflects on the legal bindingness of the statements of the Brno jurors.
