The Employment Agencies and Employment of Foreign Nationals

Abstract:

Diplomová práce se zabývá problematikou agenturního zaměstnávání se zaměřením na situace, kdy je zaměstnancem cizí státní příslušník. V úvodu práce vymezuje základní pojmy, dále obsahuje rozbor právní úpravy agenturního zaměstnávání a zaměstnávání cizinců, přičemž vychází z mezinárodní, evropské a české právní úpravy předmětné problematiky. V další části rozebírá případ agenturního zaměstnávání cizinců, známý jako kauza „stromkaři“, a soustředí se na porušování práv a možnosti ochrany práv pracovníků. V závěru práce poukazuje na problematické aspekty platné právní úpravy v této oblasti.

Abstract:

The thesis deals with the issue of agency employment focusing on situations where the employee is a foreign national. The introductory part defines basic terms and the thesis further focuses on the legal regulation of the agency employment and employment of foreigners, based on international, European and Czech legislation. The next section contains an analysis of a case of agency employment of foreigners known as the "Tree Workers Case" and focuses on violation and possibility of protection of workers' rights. At the end, the thesis points out problematic aspects of current legislation.
