Abstract:

Předmětem diplomové práce „Vlastnictví podniku nebo jiného subjektu státem - komparace jednotlivých typů“ je vymezení základních pojmů týkajících se vlastnictví právnických osob státem, včetně srovnání podle české a evropské právní úpravy. Práce popisuje základní znaky subjektů a provádí jejich komparaci se zaměřením na akciovou společnost a státní podnik. Rozebrána je otázka řízení společností a možnosti státu do něj zasahovat. V závěru práce jsou pak řešeny otázky týkající se možnosti odčerpávání zisků ze společností státem.

Abstract:

The subject of diploma thesis "Ownership of the Company or Other Subject by the State - Comparison of Various Types" is the definition of basic concepts relating to the ownership of legal entities by the state, including comparisons by Czech and European legislation. The work describes the basic characteristics of these entities and compares them with a focus on joint-stock company and state-owned enterprise. This thesis analyses the issue of the corporate governance and the possibility of the intervention of the state. The conclusion includes questions concerning the possibility of obtaining profits by the state.
