Banking contracts and their use in practice

Abstract:

Bakalářská práce se zabývá tématem bankovní smlouvy a jejich využití v praxi. Cílem je prozkoumat problematiku bankovních smluv, právní úpravu, jejich ekonomický smysl a zhodnotit současný smluvní systém u několika zkoumaných bank. Text mé bakalářské práce je členěn do třinácti kapitol. Práce se ze začátku krátce zabývá bankovnictvím v hospodářství ČR, dále o smlouvách o účtu, úvěru, o smlouvách o akreditivu, inkasu a též o jednorázovém vkladu. Všechny smluvní typy musí splňovat povinné náležitosti a v praxi pak i některé náležitosti další. Čtvrtá kapitola se zabývá účtem, další kapitola pojednává o jednorázovém vkladu, šestá o akreditivu, dále je probíráno inkaso, úvěr, devátá kapitola je o společných rysech bankovních smluv u několika vybraných bank, které jsou pak zvoleny k analýze i v praktické části. Dále se práce zabývá v desáté kapitole smluvními stranami, v jedenácté je probrán dokument o obchodních podmínkách. Dvanáctá kapitola, praktická, se zaměřuje na komparaci smluv u tří zvolených bank a končí závěrem.

Abstract:

The bachelor's thesis deals with the topic of bank contracts and their use in practice. The aim is to examine the issue of banking contracts, legislation, their economic meaning and evaluate the current contractual system at several of the examined banks. The text of my bachelor thesis is divided into thirteen chapters. From the beginning, the work briefly deals with banking in the Czech economy, as well as account and loan agreements, letters of credit, collection and also a one-time deposit. All contract types must meet the mandatory requirements and in practice some other requirements. The fourth chapter deals with the account, the next chapter deals with a one-time deposit, the sixth with a letter of credit, collection and credit is discussed, the ninth chapter deals with common features of bank agreements with several selected banks, which are then selected for analysis in the practical part. Furthermore, the thesis deals with the contracting parties in the tenth chapter, in the eleventh the document on business conditions is discussed. The twelfth chapter, practical, focuses on the comparison of contracts with three selected banks and ends with a conclusion.
