Abstract:

Tématem mé diplomové práce je Algoritmus přezkumu územního plánu. Cílem této diplomové práce byla analýza algoritmu přezku územního plánu. Jak je ze zadání diplomové práce zřejmé, za stěžejní kapitoly jsou považovány územní plán, soudní přezkum územního plánu a algoritmus přezkumu územního plánu. Každé této části se práce podrobně zabývá. V práci je nejprve podrobně popsán územní plán, jeho účel a proces přijímání a vydávání územního plánu. Ve druhé kapitole, kterou je Soudní přezkum je popsáno, jak soudní přezkum probíhá, kdo je jeho stranami a na co se zaměřuje. Poslední kapitolou je algoritmus přezkumu územního plánu. V této kapitole je přiblížen postup soudu při aplikaci algoritmu opatření obecné povahy v praxi. Dále je podrobně popsáno pět kroků, ze kterých se algoritmus skládá. Těmito kroky jsou: pravomoc vydat územní plán, působnost v oblasti územního plánování, procesní postup při vydávání územního plánu, soulad s hmotným právem a zásada proporcionality.

Abstract:

The topic of my master thesis is the Master Plan Review Algorithm. The aim of this thesis was to analyze the master plan review algorithm. As it is clear from the thesis assignment, the master plan, the judicial review of the master plan and the master plan review algorithm are considered as the core chapters. Each of these sections is discussed in detail in the thesis. The thesis first describes in detail the zoning plan, its purpose, and the process of adopting and issuing a zoning plan. The second chapter, which is Judicial Review, describes how judicial review works, who the parties are, and what it focuses on. The last chapter is the algorithm of site plan review. This chapter outlines the court's process for applying the algorithm of a municipal ordinance in practice. It then details the five steps that make up the algorithm. These steps are: the power to issue a zoning plan, the competence in the field of zoning, the procedural procedure for issuing a zoning plan, compliance with substantive law and the principle of proportionality.
