Abstract:

Tato bakalářská práce je se zabývá Druhým Dodatkem americké Ústavy a jeho interpretací a aplikací na kontrolu zbraní ve Spojených státech Amerických. První část práce je zaměřena na historii a vývoj fenoménu ozbrojené populace, zvláště v kontextu republikánské politické teorie a instituce milice. Detailně se zabývá republikanismem v Americe a vlivech, které utvářely politické myšlení v koloniích před Válkou o Nezávislost a po ní. Poslední kapitola první části sleduje historii milice v Anglii a Americe. Zaměřuje se na vojenské použití milice stejně jako na její sociální a politickou funkci. Druhá část práce je zaměřena na akademický spor o interpretaci Druhého Dodatku a jeho aplikaci na zákony o kontrole zbraní. Rozebírá postoje a argumenty jednotlivých skupin. Samostatná kapitola je věnována jazyku Druhého Dodatku. Poslední kapitola pojednává o případech Nejvyššího Soudu zahrnující Druhý Dodatek, zejména o případech považovaných za stěžejní pro legislativě kontroly zbraní.

Abstract:

This bachelor thesis deals with the Second Amendment of U. S. Constitution and its interpretation and application on gun-control issues in United States of America. The first part of thesis tracks the history and evolution of the armed population phenomenon, especially in context of republican political theory and the institution of militia. It deals in detail with the American republicanism and influences that shaped the thought in American colonies prior to War of Independence and after. Last chapter of first part follows the history of militia in England and America. It focuses on its military use as well as its social and political functions in America. The second part of the thesis is focused on scholarly divide over the interpretation of the Second Amendment and its application to gun-control legislative in the USA. It focuses on stances and arguments of opposing scholastic camps and one chapter is dedicated to analysis of language used in Second Amendment. Final chapter focuses on the Supreme Court cases involved with Second Amendment with focus on those considered crucial for gun-control legislative.
