Regulation of General Nature as an Administrative Act

Abstract:

Tato diplomová práce se věnuje institutu opatření obecné povahy jako smíšenému správnímu aktu, nabídne rovněž pohled do oblasti jednotlivých správních aktů, a sice aktů normativních a individuálních. Ve svém úvodu se práce věnuje historickému exkurzu opatření obecné povahy z pohledu české právní úpravy, přičemž neopomíná taktéž na historický vývoj tohoto institutu. Kapitoly věnující se samotnému opatření obecné povahy jsou pro tuto kvalifikační práci stěžejní. Popis, formulace, systematizace a vymezení institutu ve správním řádu jako klíčovém právním předpise, lze považovat za elementární faktory a „odrazové můstky“ této části. Za pomocí judikatury soudů a studia odborných stanovisek, se práce pokusí ukázat na klíčové případy, které měly pro teoretické vymezení institutu zásadní význam. Diplomová práce nabídne rovněž pohled do problematiky procesní stránky, pokusí se seznámit se základními body a instituty s tímto souvisejícími. V neposlední řadě pak poskytne pohled do praktické sféry, kde seznámí opatření obecné povahy ve spojení s vybranými složkovými právními předpisy, přičemž neopomene na aplikaci institutu v praxi.

Abstract:

This diploma thesis is focused not only on the measure of a general scope as a mixed administrative act but also on administrative measures such as normative or individual ones. The thesis contains several chapters. In the beginning of the thesis, it gives an overview of the history and development of the measure of a general scope in connection with the Czech legal system. Following chapters represents the crucial part of the thesis, which is the measure of a general scope itself. Mainly it is its description, characteristics, systematization and definition of the measure of the general scope itself in the light of the Administrative code as the main law of this part of the legal system. The aim of the thesis is to show the crucial indicators, which have the main importance for the definition of the measure of a general scope through analysing case law and expert papers. The thesis also offers the procedural point of view of the whole matter. Finally, the thesis contains chapters, which are focused on the practical application of the measure of a general scope and other laws, which are also part of the whole issue.
