Abstract:

Tato diplomová práce se zabývá pracovním poměrem na dobu určitou, který je považován za flexibilní formu zaměstnání. Práce rozebírá sjednání, přeměnu a zánik tohoto typu pracovního poměru. Součástí diplomové práce je rozbor platné právní úpravy a stručný historický exkurz. Dále se věnuje specifikům znevýhodnění ve srovnání se zaměstnanci v pracovním poměru na dobu neurčitou a analyzuje problematiku opakovaného uzavírání smluv včetně judikatury SDEU. V závěru práce jsou formulovány návrhy de lege ferenda ke zlepšení ochrany zaměstnanců a právního rámce.

Abstract:

This thesis examines fixed-term employment relationship, considered as a flexible form of employment. It discusses the establishment, transformation and termination of this type of employment relationship. The work includes an analysis of the current legal regulations, and a brief historical overview. It also addresses the specifics of disadvantages compared to employees in an indefinite-term relationship and analyses the issue of successive fixed-term employment contracts, including CJEU case law. In conclusion, the thesis proposes suggestions de lege ferenda for improving the protection of employees and the legal framework.
