Art on the Edge. Art vs. Law from 60’s to the Present.

Abstract:

Předkládaná práce se zaměřuje na umělecké soudní procesy jako místa střetu rozdílných názorů na umění a jeho meze. Konkrétně se zabývá rozpory mezi svobodou projevu a omezeními zákonem. Procesy s umělci tak nabízejí diskusi k tématům o hranicích mezi uměním a trestným činem a mezi uměním a aktivismem (politickým, sociologickým, ekologickým). Medializace procesů tyto diskuse rozšiřují do řad veřejnosti. Soud v těchto případech vystupuje jako instituce, která má pravomoc vynášet rozsudky, a tak i pravomoc určovat tyto hranice. Soudní proces však také můžeme chápat jako mediální nebo i umělecký proces obhajující a rozšiřující status umění. Práce je rozdělená do čtyř okruhů. První z nich se zabývá světově známými případy soudních procesů s umělci: 1 000-Yen Incident (Genpei Akasegawa), Destruction in Art Symposium (Gustav Metzger a John Sharkey) a kauzami Vídeňských akcionistů (Hermann Nitsch, Günter Brus, Otto Muehl). Další část se zaměřuje na kolize novomediálních děl a kolize aktivismu zastoupené skupinami Greenpeace, RTMark a Critical Art Ensemble. Třetí okruh nabízí pohled do problematiky cenzury v umění, který zastupují umělci ze čtyř zemí: Andres Serrano a Karen Finley (USA), Dorota Nieznalska (Polsko), Ai WeiWei (Čína), Avděj Ter-Oganjan a Pussy Riot (Rusko). Závěrečná kapitola mapuje situaci v České (Československé) republice od 60. let po současnost: Eugen Brikcius (60. léta), The Plastic People of the Universe (70. léta), Tomáš Ruller (80. léta), Tomáš Vaněk (90. léta), Roman Týc, Rafani a Ztohoven (21. století). U výše vybraných procesů mapuji základní informace o průběhu. Uvádím fakta o době a místě konání procesu a představuji díla, která byla příčinou přestupku, znění oficiálních žalob i konečného verdiktu. Nastiňuji reakci autora i veřejnosti na proces. Analýzou těchto faktorů si kladu za cíl nalézt společný základ jednotlivých procesů a jejich okolností a na základě toho identifikovat odlišné momenty. Ty totiž způsobují, že každý proces má unikátní průběh.

Abstract:

This master thesis deals with artistic trials as sites of conflict concerning different views of art and its boundaries. It is focused on conflicts between freedom of expression and the constraints of the law. Trials with artists offer a field of discussion on issues such as the borders between art and crime and those between art and activism (political, sociological, ecological). The coverage of lawsuits in the media extend this discussion to the public sphere. The court in these cases acts as an institution that has the power to pass judgment and thus the power to determine these limits. The lawsuit can be understood in itself as a media, even an art process defending and enlarging the status of art. The thesis is divided into four sections. The first deals with internationally renowned cases against artists: 1000-Yen Incident (Genpei Akasegawa), Destruction in Art Symposium (Gustav Metzger and John Sharkey) and the Vienna Actionists (Hermann Nitsch, Günter Brus, Otto Muehl). The second section focuses on the collision between new media art and activism representing art groups such as Greenpeace, RTMark and Critical Art Ensemble. The third range offers insight into the issue of censorship in art, representing artists from four countries: Andres Serrano and Karen Finley (USA), Dorota Nieznalska (Poland), Ai WeiWei (China), Avděj Ter-Oganjan and Pussy Riot (Russia). The last chapter focuses on the situation in the Czech (Czechoslovak) Republic from the 1960’s: Eugen Brikcius (60’s), The Plastic People of the Universe (70’s), Tomáš Ruller (80’s), Tomáš Vaněk (90’s), Roman Týc, Rafani and Ztohoven (21st century). Through the selected lawsuits primary information about their course of events is examined. I present facts about the date and place of the trial and the works that were the cause of the controversy. I present the official suit filed and the judgement. I mention the reactions of the authors and the public at large to the trial. The analysis of these facts aims toward finding a common foundation and circumstances to identify various moments. These moments cause each lawsuit to be unique.
