Assessment of legislative protection of forests and forestry in tropical areas - the case of Suriname, the Democratic Republic of Congo and Laos

Abstract:

Tato bakalářská práce se zabývá současnou legislativou a právní úpravou tropických lesů se zaměřením na aspekty související s lesním hospodářstvím a současným problémem odlesňování a nezákonné těžby dřeva na příkladu Laosu, Surinamu a DRK. Aby byl problém představen v širších souvislostech, je právní aspekt doplněn o některé základní poznatky z ekonomie a lesnické vědy. Práce obsahuje srovnávací analýzu přírodních, ekonomických, historických a právních zákonitostí mezi všemi zkoumanými regiony. A také analyzuje možné nedostatky právního systému a právní úpravy mezi soukromým a veřejným lesnickým sektorem těchto zemí. První část práce (kapitola 6) se zabývá významem a úlohou tropických lesů pro existenci života na planetě, rozdělením funkcí lesa, jejich rozšířením a charakteristikou. Druhá část práce (kapitola 7 a 8) popisuje historické vzájemné vztahy, které ovlivnily vývoj lesní legislativy v Surinamu, Laosu a Demokratické republice Kongo. Podrobněji jsou rozebrány vztahy mezi jednotlivými místními komunitami (Surinam – Maronové, Laos - Lao Theung a Lemové, Kongo - Aka lovci-sběrači a Kaka a Bondongo rybáři-farmáři), typy možných práv k vlastnictví lesa (dědičná držba, obecní těžební licence a práva na využívání komunitních lesů, např.) Pozornost je věnována historickým procesům nákupu a prodeje vzácných lesních produktů. Část 8 kapitoly se zabývá také regulací lesů ze státního a právního hlediska v průběhu několika staletí. Podrobněji jsou rozebrány procesy formování nabídky a poptávky po lesních produktech. Těžiště této bakalářské práce spočívá ve třetí části práce (kapitola 9). Tato závěrečná část je věnována studiu moderní legislativy, komerčního a veřejného lesnického sektoru. Podrobně je zde rozebráno hospodaření a správa lesů daných zkoumaných regionů. Kapitola je rozdělena do 5 hlavních podkapitol (lesní zdroje, vlastnictví půdy a její komerční a veřejné využití, představení politických a legislativních iniciativ a jejich aktivit v regionech, certifikace lesů a lesní hospodářské plánování). Je uveden stručný přehled lesních zákonů, které se vztahují k lesnímu hospodářství. A dále jsou probrány všechny druhy zpracovatelských/výrobních, daňových, obchodních a dopravních zákonů. V závěru je rovněž uvedena srovnávací charakteristika (pomocí SWOT analýzy) všech zkoumaných parametrů (přírodních, historických, ekonomických a legislativních). Autor článku stručně uvádí malou diskusi o efektivitě těchto legislativních a správních procesů.

Abstract:

This bachelor thesis examines the current legislation and regulation of tropical forests, focusing on forestry-related aspects and the current problem of deforestation and illegal logging, using Laos, Suriname and the DRC as examples. In order to present the problem in a broader context, the legal aspect is complemented by some basic insights from economics and forestry science. The paper includes a comparative analysis of natural, economic, historical and legal patterns among all the regions studied. It also analyses the possible shortcomings of the legal system and regulation between the private and public forestry sectors of these countries. The first part of the thesis (Chapter 6) deals with the importance and role of tropical forests for the existence of life on the planet, the distribution of forest functions and their characteristics. The second part of the thesis (Chapters 7 and 8) describes the historical interrelationships that have influenced the development of forest legislation in Suriname, Laos and the Democratic Republic of Congo. The relationships between the different local communities (Suriname – Maron, Laos – Lao Theung and Lem, Congo - Aka hunter-gatherers and Kaka and Bondongo fisher-farmers), the types of possible forest tenure rights (hereditary tenure, communal logging licenses and community forest use rights, for example), and the types of forest tenure rights (e.g., forest tenure rights) are discussed in detail. Attention is given to the historical processes of buying and selling scarce forest products. Part 8 of the chapter also looks at the regulation of forests from a state and legal perspective over several centuries. The processes shaping the supply of and demand for forest products are discussed in detail. The focus of this thesis lies in the third part of the thesis (Chapter 9). This final part is devoted to the study of modern legislation, commercial and public forestry. The management and administration of the forests of the regions under study are discussed in detail. The chapter is divided into 5 main subchapters (forest resources, land tenure and its commercial and public use, introduction of policy and legislative initiatives and their activities in the regions, forest certification and forest management planning). A brief overview of the forest laws that are relevant to forest management is given. And all types of processing/production, tax, trade and transport laws are discussed. Finally, a comparative characterization (using SWOT analysis) of all the parameters (natural, historical, economic and legislative) examined is also presented. The author of the paper briefly provides a small discussion on the effectiveness of these legislative and administrative processes.
