The diference between the settlement of claim from the Motor Third Party liability insurance and the all-risks insurance

Abstract:

Základním úkolem této práce je ukázat rozdílné nároky poškozených a pojištěných při likvidaci pojistné události z havarijního pojištění nebo z pojištění odpovědnosti z provozu motorového vozidla. Nastínit možnost využití přímé likvidace, kterou již první pojišťovny využívají. A zejména rozebrat problematiku amortizace a využití aftermarketových dílů. V praktické části je popsána současná metodika výpočtu skutečné škody. V závěru práce je přiblížen postup, jakým způsobem by bylo možné sjednotit metodiku stanovení skutečné škody, zejména v návaznosti na přímou likvidaci.

Abstract:

The basic target of this work is to demonstrate different claims of the damaged policy clients at the settlements of their insurance event claims concerning all-risks car insurance or insurance against responsibility, then to show the existence of the direct settlement of a claim (which several incurance companies have already used), and mainly to analyse the questions of amortization and the utilization of aftermarket spare parts. In the practical part the present methodology of true damage calculation is described. At the end of this work I state a possible way how to unify the methodology of real damage calculation (mainly in relation to the direct settlement).
