Abstract:

Pojetí věci, jako jedno z klíčových ustanovení při rekodifikaci občanského práva, budí mnoho sporů i po pěti letech účinnosti zákona č. 89/2012 Sb. Samotná diplomová práce je koncipována tak, aby se dotkla nejen pozitivně právní úpravy, ale i teoretické nauky. Nejprve je pozornost věnována římskému právu, a to nejenom z pouhé úcty k tradici, která je v souvislosti s občanským právem nezanedbatelná. Na tomto místě je rozpracován samotný pojem věc a s tím související jednotlivé rozdělení věcí, jež daná doba znala. Druhá část je koncipována z hlediska teorie práva a občanskoprávní nauky a je zkoumán právní vztah v souvislosti s věcí v právním slova smyslu coby sekundárním předmětem práv a povinností. Posléze je přikročeno k otázce užšího a širšího pojetí věci, kde je cílem poukázat jak na pozitiva, tak i negativa obou teoretických konceptů. Zakončení kapitoly je pojato jako drobný exkurz do práva veřejného, respektive trestního práva hmotného a jeho pojetí institutu věci. Pozornost je rovněž věnována postupnému historickému vývoji onoho uchopení pojmu věc, a to od úpravy ABGB až po občanský zákoník z roku 1964, včetně vládního návrh pocházejícího z roku 1937. Předposlední kapitola analyzuje recentní právní úpravu institutu věci, počínaje stěžejní definicí v ustanovení § 489 občanského zákoníku, až po následné zaměření se na jednotlivé rozdělení věci de lege lata a legislativní uchopení termínů jako věc hromadná či příslušenství věci. Také je zde nastíněno pojetí zvířete či lidského těla z pohledu soukromé pozitivně právní úpravy. Závěrečná část práce poskytuje úvahu de lege ferenda, kde jsou předestřeny vlastní názory na to, jak onu úpravu pojmout.

Abstract:

The conception of the "Thing", as one of the key institutions in recodification of the civil law. It arouses many disputes even after five years of legal effect of the law 89/2012 Sb. The concept of my thesis is chosen to not just positively affect the legislation, but the theory as well. First we pay attention to the Roman Law, not just from the respect to the tradition, which is undeniable in coherence with the civil law. At this point the whole term "Thing" is elaborated, and with that, all the other related "Things" distributions as well. The Second part's concept is from the point of the law theory and the civil law as well and legal relationship related to the "Thing" in law meaning, as a secondary subject of the law and obligations is being studied as well. Next I step to the question of narrower and wider conception of the thing, where the object is to point both at the positives and negatives of both theoretical concepts. The end of the chapter is conceived as a small excursion to the public law, respectively, to the Criminal substantive law and it's conception of the "Thing". Attention is drawn to the gradual historical evolution of understanding the term "Thing", from the edition ABGB to the Civil Code from the 1964, including government proposal coming from 1937. The penultimate chapter is analysing recent legislation of the institute of "Thing", beginning with the key definition in assignation § 489 and ending with the focus on each segragation of the "Thing" de lege lata and with legislative understanding of the terms - common thing, thing accessories. The concept of understanding the term "Animal" or "Human body" from the point of private positive legislation is being dealt with.The very last part of my thesis is giving you a reasoning de lege ferenda, where my honest opinions, on how to understand this legaslation are kindly mentioned.
