Comparison of the Czech and Lithuanian Family Law

Abstract:

Tato diplomová práce se zabývá srovnáním právní úpravy institutů jednotlivých typů rodinného soužití a poměrů mezi rodiči a dětmi v České a Litevské republice. Obě právní úpravy jsou porovnány nejen vzájemně, ale také s Principy evropského rodinného práva. Diplomová práce je členěna na šest částí. V první části jsou vymezeny základní pojmy, druhá se zaměřuje na historický vývoj úpravy rodinného práva v obou zemích, ve třetí jsou obsaženy prameny rodinného práva. Čtvrtá část se zabývá právní úpravou manželství, registrovaného partnerství, nesezdaného soužití a poměrů mezi rodiči a dětmi v jednotlivých zemích de lege lata. Pátá část je věnována tendencím dalšího vývoje právní úpravy ve světle evropských standardů, šestá pak úvahám de lege ferenda.

Abstract:

This diploma thesis aims to compare the legal regulation of individual types of partnerships and relationships between parents and children in the Czech Republic and Lithuania. Both regulations are compared not only to each other but also to the Principles of European Family Law. The diploma thesis consists of six parts. The first defines the basic concepts used throughout, the second concentrates on the historical development of family law in either country, the third contains the sources of family law. The fourth part is dedicated to the legal regulation of marriage, registered partnership, cohabitation and parent-children relationships in either country, de lege lata. The fifth section is devoted to the tendencies of further development of the law in light of European standards, the sixth to considerations de lege ferenda.
