Abstract:

Tato diplomová práce se zabývá existencí či absencí elektronického důkazu v rámci českého práva. Dále je v souvislosti s elektronickým důkazem v práci srovnáváno, jaký je aktuální stav legislativy České republiky v porovnání s vybranými evropskými státy. Následně se práce věnuje zajišťování elektronického důkazu a s tím spojenými riziky, eliminaci těchto rizik i samotnému zajištění elektronického důkazu proti manipulaci s ním. Diplomová práce je rozdělena do pěti kapitol. První kapitola je zaměřena na teorii, týkající se základních pojmů, důležitých pro správné pochopení této magisterské práce. Ve druhé kapitole je v obecné rovině rozebrán pojem důkaz. Třetí kapitola se pak týká samotných zajišťovacích institutů, a to jak z pohledu teoretického, tak i praktického. Poslední dvě kapitoly jsou součástí praktické části, kdy čtvrtá kapitola obsahuje primárně případovou studii a pátá se zaměřuje na návrhy a doporučení pro zlepšení současné situace. Cílem diplomové práce je analyzovat současnou právní úpravu ve vztahu k elektronickým důkazům. Na základě provedené analýzy české a mezinárodní právní úpravy v teoretické části práce vymezit pojem elektronický důkaz, případně navrhnout změny v legislativě tak, aby odpovídala stavu, ke kterému se Česká republika zavázala ratifikací úmluvy o počítačové kriminalitě.

Abstract:

This thesis deals with the existence or absence of electronic evidence in Czech law. Furthermore, in relation to electronic evidence, the thesis compares the current state of Czech legislation with selected European countries. Subsequently, the thesis focuses on collecting electronic evidence and the risks associated with this process, the elimination of these risks and the protection of electronic evidence against unauthorized manipulation. The thesis is divided into five chapters. The first chapter focuses on theory related to the basic terms important for a proper understanding of this master thesis. The second chapter discusses the general aspects of the term proof or evidence as a legal term. The third chapter then covers the topics of seizure institutes per se, both from a theoretical and practical perspective. The last two chapters fall under the practical part of the thesis, where the fourth chapter contains primarily a case study and the fifth chapter focuses on suggestions and recommendations for improving the current situation. The aim of the thesis is to analyse the current legal framework in relation to electronic evidence. On the basis of the analysis of Czech and international legislation in the theoretical part of the thesis, to define the concept of electronic evidence and, where appropriate, to propose changes in the legislation in order to correspond to the state to which the Czech Republic has committed itself by ratifying the Budapest Convention on Cybercrime.
