System of Payment's Services Market within the Czech Republic with a View to SEPA

Abstract:

Práci jsem zpracovala jako ucelený přehled informací týkající se problematiky aktuálně probíhajících a chystaných změn v oblasti platebního styku v kontextu přijaté směrnice o platebních službách na vnitřním trhu. Snažila jsem se zachytit podstatu těchto změn v konkrétní v souvislosti s Českou republikou. Tato práce postihuje celé spektrum prvků jako základ do terminologie oblasti platebního styku a jeho instrumentů, popis stávajících právních předpisů České republiky týkajících se jednotlivých oblastí platebního styku, výklad směrnice o platebních službách na vnitřním trhu, rozbor vzniklých diskrecí a řešení některých z nich přijatých Českou republikou, otázku transpozice směrnice do legislativy České republiky, základní popis projektu SEPA a jeho nástrojů a na závěr shrnutí přínosů projektu zejména z pohledu uživatele platebních služeb. Záměrem práce je zmapovat problematiku směrnice a projektu SEPA takovým způsobem, aby po přečtení této práce měl čtenář, který dosud neměl příležitost zaměřit se na tuto problematiku detailněji nebo o ní nikdy neslyšel, jasnou a ucelenou představu o tom, k jakým změnám v oblasti platebního styku v České republice postupně dojde.

Abstract:

On November 13, 2007 the Directive 2007/64/EC of the European Parliament and of the Council of payment services in the internal market was adopted in Europe and it will be effective as of November 1, 2009. The fundamental concept of my graduation theses is based on the information relevant for the reformation of the financial systems in Europe in context of above mentioned Direction. I have endeavored to record the principles of these changes in particular connection with the Czech Republic. This theses reveals varies spectrums of components as fundamental terminology of the financial services and existing relevant parts of the legal enactments of the Czech Republic. First of all, interpretation of the Directive on financial services in the internal market, and the analysis of arbitrary powers that came into being in connection with this Directive and the presentation of these solutions adopted by the Czech Republic, the major questions that may arise of a transposition of the Direction into the system of the Czech Republic's law, the basic description of SEPA project and its instruments and at the conclusion summary of benefits of the project especially from the point of the financial service users. The intention of my theses was to inform my readers of the fundamental problems of Directive and SEPA project in such a way that after reading of this every reader, even someone who has never had an opportunity to target in detail on these issues, would have a clear and comprehensive idea of what kind of changes in the sphere of the financial services we might expect in the Czech Republic.
