Abstract:

Tato diplomová práce se zabývá institutem ochranných opatření v trestním právu. Ochranná opatření jsou projevem dualismu trestních sankcí v českém trestním právu, neboť představují vedle trestů další druh trestněprávní sankce. Oproti trestům, které mají mimo jiné též represivní povahu, sledují ochranná opatření spíše terapeutické a výchovné působení. Ochranná opatření zohledňují osobnost pachatele. Mladistvým pachatelům se ukládá ochranná výchova dle zákona o soudnictví ve věcech mládeže, popř. pachatelům ve věku od dvanácti do patnácti let za čin jinak trestný v občanskoprávním řízení. Ochranné léčení je ukládáno dospělým pachatelům dle trestního zákona. Klíčovými pojmy jsou zde nepříčetnost, zmenšená příčetnost, stav vyvolaný duševní poruchou a zneužívání návykových látek. Toto ochranné opatření ovlivňují lékařské a psychologické aspekty. Posledním ochranným opatřením je zabrání věci. Nevztahuje se primárně na pachatele trestného činu, ale na ochranu společnosti a jiných obecných zájmů před ohrožením společnosti, které tato věc způsobila nebo může způsobit.

Abstract:

This dissertation is dealing with the subject of the protective precautions in the criminal law. They form the second type of the penal sanctions aside the penalties. They consider the personality of the offender and rather have curative and educational impression. The protective education is regulated the juvenile delinquents for the crime according to code of the justice over the juveniles or the offenders older than 12 and younger than 15 years for the act otherwise criminal, here is the protective education regulated in civil action. The compulsory treatment is regulated the adult offenders according to criminal code. The basic therms in this ocassion are irresponsibility, lowered responsibility, mental disorder and exploitation of the habit - forming substances. This measure is influenced of the medical and psychological aspects. The last of the protective precautions is the detainer. It doesnt apply the offender of the crime clean, but it covers the society prior to the threat this thing caused or could cause.
