The role and competencies of the president of the Czech republic

Abstract:

Tato bakalářská práce se zabývá hlavou státu Československé (první) republiky a současné České republiky. Je rozčleněna na 3 základní části. V části první popisuje postavení prezidenta Československé republiky a vymezení tehdejší hlavy státu jako nejvyššího ústavního činitele. Zkoumá proces nabytí, trvání a pozbytí úřadu prezidenta Československé republiky. Dále se zabývá vztahem prezidenta a vlády a zákonitostmi tohoto vztahu z hlediska paragrafového znění tehdejší ústavy. Popisuje vztah prezidenta k zákonodárnému sboru první republiky a především jeho možnosti vůči tomuto shromáždění. Současně se však zabývá restrikčními opatřeními zákonodárného sboru vůči osobě hlavy státu. V závěru této části podrobně rozpracovává pravomoci prezidenta v oblasti vrchního velení branné moci. V druhé části práce jsou popsány způsoby volby prezidenta České republiky, kritéria kladená na jeho osobu a způsob nabytí a pozbytí prezidentského úřadu. Dále je zkoumáno postavení součastné hlavy státu a její vztah k vládě České republiky. Jsou zde specifikována práva prezidenta vůči Parlamentu ČR a naopak možnosti Parlamentu ke změně veta prezidenta republiky. Jsou popsány jeho pravomoci jak v oblasti zákonodárné moci, tak v oblasti výkonu funkce vrchního velitele ozbrojených sil České republiky. V poslední části práce je provedeno srovnání postavení a pravomocí obou těchto prezidentů a jsou blíže specifikovány okolnosti a vlivy společenského vývoje, které jsou rozhodující pro odlišnosti v jejich postavení a právech.

Abstract:

This bachelor work deals with the head of state of the first Czechoslovak Republic and the present Czech Republic. It is divided into three basic parts. In the first part, it describes the status of the President of the Czechoslovak Republic and the definition of the head of state then as a supreme constitutional official. It researches the process of gaining, holding and losing the office of the President. Next it deals with the relationship between the President and the Government and the rules of this relationship from the point of view of a paragraph wording of the constitution from that period. It describes the President’s relationship to the legislative body of the first Czechoslovak Republic and above all his possible actions toward this assembly. At the same time, it deals with the restrictive measures of the legislative body toward the head of state. In the conclusion of this part, it explains the President’s powers concerning the high command of the armed forces. In the second part of the work, procedures for the election of the President of the Czech Republic are described as well as the criteria placed on the person of the President and the ways of gaining and losing the office. Next the status of the present head of state and its relationship to the Government of the Czech Republic is researched. The President’s rights toward the Parliament of the Czech Republic and on the other hand the Parliament’s possible actions to override a presidential veto are specified here. The President’s powers concerning both legislative power and the post of the commander-in-chief of the armed forces of the Czech Republic are described. In the third part of the work, the status and the powers of both the presidents are compared. Here, the circumstances and the influence of the social development of their respective periods are examined which are crucial for specifying the differences between their presidential status and rights.
