Administrative Discretion and Protection against Its Abuse in the Czech Republic and Germany

Abstract:

Tato diplomová práce srovnává institut správního uvážení v českém a německém právním řádu. Je v ní zkoumána úprava správního uvážení v zákonech, přístup právní teorie a praktická aplikace. Zvláštní důraz je kladen na možnosti právní ochrany proti jeho zneužití. Práce se snaží poukázat na problematické aspekty institutu a nalézt jejich dopady v praktickém užití.

Abstract:

This thesis compares the institute of administrative discretion in the Czech and the German law. It examines the law regulation, the approach of the legal theory and the practical application of the institute. Special emphasise is put on the tools of legal protection against the abuse of the administrative discretion. The theses aims to highlight the problematic aspects and to find their impacts on the practical use.
