"Superficies solo cedit" Principle in a historical context

Abstract:

Tématem této bakalářské práce je zásada „superficies solo cedit“ v historickém kontextu. Cílem práce je zhodnotit odlišné přístupy k jejímu uplatňování během historického vývoje včetně zhodnocení úpravy této zásady v novém občanském zákoníku. V práci jsou s ohledem na cíl aplikovány tři metody – deskripce, analýza a komparace. V první části práce je kladen důraz na původ zásady v římském právu. Další část je logicky členěna podle občanských zákoníků platných na našem území. Poslední část práce je zaměřena na současný občanský zákoník, ve kterém došlo k opětovnému zavedení superficiální zásady.

Abstract:

The theme of this bachelor thesis is the principle "Superficies solo cedit" in the historical context. The aim of this thesis is to evaluate different approaches to application of this principle during the historical development, including evaluation of conception of this principle in the new Civil Code. There are applied three methods with regard to the aim - description, analysis and comparison. In the first part, the emphasis is put on the origin of the principle in Roman law. Another part is logically divided according to the civil codes in force in our country. The last part is focused on the current Civil Code, in which is the principle “Superficies solo cedit” again implemented.
