The use of force by a police officer

Abstract:

Tato bakalářská práce je zaměřena na výklad jednotlivých ustanovení hlavy IX zákona č. 273/2008 Sb. o Policii České republiky, ve znění pozdějších předpisů, které jsou spojeny s použitím donucovacích prostředků policistou. V práci je proveden komentář k jednotlivým donucovacím prostředkům, oprávněním a povinnostem policisty před a po jejich použití a také ke zvláštním omezením při jejich použití. Dále je v práci provedena analýza tří zákroků, při kterých byly donucovací prostředky použity, s jasným závěrem, zda jejich použití bylo přiměřené a oprávněné, či nikoli.

Abstract:

The purpose of this under-graduate study is to explain the individual designated headings IX legislation no. 273/2008. of the Police force of the Czech Republic, in the formulation of the latest directive, which is associated with the use of coercive means by police. Within the study commentary is provided on each individual coercive mean, and the authority and responsibility of the police prior to and post its use and also of exceptional limitations on its use. In the study there is also analysis of three police interventions where coercive means were used, with clear conclusions on whether the use of these means were appropriate or not.
