Legal and Ethical Limits of Special Secondary Education Funding

Abstract:

Tato diplomová práce s názvem Právní a etické meze financování speciálního středního školství je zaměřena na problematiku zařazování žáků se speciálními vzdělávacími potřebami do speciálních škol, a to s ohledem na právní, etické, finanční a pedagogické aspekty této problematiky. Zejména je reflektován aktuální vývoj právní úpravy ve smyslu novelizace zákona č. 561/2004 Sb., zákon o předškolním, základním, středním a vyšším odborném vzdělávání, školský zákon, ve znění pozdějších předpisů, a jeho prováděcích předpisů.K této reformě dochází na základě povinnosti implementovat rozhodnutí Evropského soudu pro lidská práva ve Štrasburku ve věci D. H. and Others vs. Czech Republic, kdy byl Evropským soudem shledán postup České republiky při zařazování žáků do režimu speciálního školství jako diskriminační a segregační.

Abstract:

The thesis titled Legal and Ethical Limits of Secondary Special Education Funding is focused on the integration of pupils with special educational needs in special schools, with regard to the legal, ethical, financial and pedagogical aspects of this issue.In particular, the current development of legislation within the meaning of the amendment to Act no. 561/2004 Coll., On preschool, primary, secondary and higher vocational education, the Education Act, as amended, and its implementing regulations, is reflected in.This reform has appeared on the grounds of the obligation to implement the decision of the European Court of Human Rights in Strasbourg in the case of D.H. and Others vs. Czech Republic, where the European Court found the procedure of the Czech Republic, concerning the placement of pupils into special education, discriminatory and segregated.
