Consumer Protection

Abstract:

Tématem této bakalářské práce je ochrana spotřebitele. V první části práce je zachycena legislativní úprava ochrany spotřebitele, a to jak v tuzemském tak i v evropském právu v rámci zásadních právních norem. Další část konkretizuje jak subjekty ochrany spotřebitele, tak i pojmy v této oblasti se vyskytující, jimiž jsou např. výrobek a služba, výrobce a distributor. V této části je zároveň nastíněno ohrožení spotřebitele v jeho právech. V praktické, čtvrté části, jsou charakterizována řešení spotřebitelských sporů a to jak formou soudního řešení, tak i mimosoudního. U soudních řešení jsou analyzovány jednotlivé judikáty zejména nejvyššího soudu, které jsou pro další rozhodování soudů nižší úrovně závazné. Řešení spotřebitelských sporů mimosoudním způsobem je vyhodnoceno v posledních podkapitolách této části.

Abstract:

The topic of this bachelor thesis is "Protection of a Consumer". In the first part of the thesis is explained a legislative regulation of consumer's protection both in the internal and also in European law with emphasize on essential legal norms. The next part describes subjects of consumer's protection and also institutions in this sphere, for example: product and service, manufacturer and distributor. In this part is also outlined a threat of consumer in his laws. In the practical fourth part are characterized solutions of consumer disputes in two ways - with a form of judicial settlement and also out of court. At the judical settlements are analyzed practices of the courts, especially of the High Court, which are important for the next decisions of courts with lower level. The solution of consumer disputes in out of court way is evaluated in the last subchapters of this part.
