Factors affecting the legal forms of non-profit organizations

Abstract:

Předmětem diplomové práce „Faktory ovlivňující právní formy neziskových organizací“ je identifikovat klíčové faktory, které ovlivňují právní formy neziskových organizací. Občanská sdružení jsou od 1. 1. 2014 považována za spolky. Mnoho z nich zvažuje, zda setrvat v právní formě spolek, anebo převést svoji organizaci na jinou právní formu (ústav, sociální družstvo). První část je věnována postavení neziskových organizací v rámci veřejného sektoru, typologii nestátních neziskových organizací a legislativním změnám. V druhé části jsou předloženy potenciální faktory, které mohou ovlivnit vznik neziskových organizací, stejně jako transformaci stávajících organizací. V poslední části je pak formou rozhovoru, jak se stávajícími spolky, tak s již transformovanými, potvrzena nebo vyvrácena domněnka potenciálních faktorů. Výsledkem práce je interpretace výzkumu a ověření teoretické oblasti s praktickou částí.

Abstract:

The subject of the thesis "Factors Affecting the Legal Forms of Non-profit Organizations" is to identify the key factors that affect the legal status of non-profit organizations. From 1. 1. 2014, Civic Associations are considered Associations. Many Civic Associations are considering whether to keep the legal form of the Association or to convert their organization into another legal form (Institute or Social Cooperatives). The first part of the thesis is dedicated to the status of non-profit organizations in the public sector, to the typology of NGOs, and to legislative changes. The second part introduces the potential factors that could affect the establishment of non-profit organizations, as well as the transformation of existing organizations. Based on interviews carried out with existing and transformed Associations, the last part confirms or rebukes the assumed potential factors. The outcome of the thesis is an interpretation of research findings and verification of the theoretical and the practical part.
