Legal Instruments of Client Protection in Internet Payments - an Overview

Abstract:

Tématem předkládané bakalářské práce je Přehled právních nástrojů ochrany klienta u internetových plateb. V práci se zabývám hypotézou, zda "právní nástroje na ochranu klienta při realizaci plateb na internetu odpovídají současným platebním technologiím a platebním zvyklostem." V obecné části práce je pojednáváno o platebním světě a jeho rozvoji. Dále se v práci věnuji jednotlivým platebním metodám s důrazem na elektronický platební styk a s tím související ochranu dat, s krátkým exkurzem do bezpečnostních pokynů vybraných subjektů pohybujících se na finančním trhu. V rámci tématu ochrany klienta u internetových plateb pak rozebírám základní právní aspekty této problematiky z hlediska právních norem České republiky a Evropské unie, přičemž se zaměřuji zejména na metodiku ochrany klienta ve vztahu k řešení sporů vzniklých v souvislosti s prováděním internetových plateb. Závěrečná část práce je pak věnována, z mého pohledu, významnému institutu v oblasti ochrany spotřebitele, a tím je finanční arbitr.

Abstract:

As the title suggests, this bachelor thesis provides an Overview of the Legal Instruments of Client Protection in Internet Payments. A hypothesis is examined whether the "legal instruments protecting the client when making internet payments are adequate for nowadays payment technologies and the established practice in payments." The general part of the thesis deals with the world of payments and its development. Then individual payment methods are described with a focus on the electronic system of payments and the ensuing data security and protection, together with a brief excursion into the security instructions of the selected subjects operating on the financial market. Within the framework of a client´s protection during internet payments the basic legal aspects of the area are analyzed with respect to the legal norms of the Czech Republic and the European Union. Especially the methods of protecting a client dealing with any disputes arising from internet payments are discussed. The thesis concludes with an important institute for consumer protection, which is the Financial Arbitrator.
