The influence of the administration on the implementation of the institute of expulsion

Abstract:

Bakalářská práce je věnována tématu institutu vykázání a vlivu administrativy na praktickou realizaci tohoto institutu a jejím základním cílem je zjistit na základě dotazníkového šetření mezi policisty míru vlivu administrativních nároků na realizaci institutu vykázání-úkonu na ochranu oběti před domácím násilím. V teoretické části jsou vymezeny ústřední pojmy celého zkoumaného tématu. Praktická část práce interpretuje výsledky dotazníkového šetření mezi policisty na téma přístupu k využívání institutu vykázání v případech domácího násilí. Jak bylo zjištěno, naprostá většina policistů má s realizací tohoto institutu určitou zkušenost, nicméně problémem je pro policisty zejména administrativní náročnost, která je s realizací tohoto institutu spojena. Proto polovina policistů již někdy tento institut vlivem nadměrných administrativních nároků neuložila. Žádoucí je proto snížení této administrativní náročnosti a také úprava a aktualizace formuláře SARA DN, aby bylo hodnocení případů domácího násilí jednoznačnější a transparentnější.

Abstract:

The bachelor's thesis is dedicated to the subject of the reporting institute and the influence of the administration on the practical implementation of this institute, and its basic goal is to determine, based on a questionnaire survey among police officers, the degree of influence of administrative demands on the implementation of the reporting institute as an act to protect the victim from domestic violence. In the teoretical part, the central terms of the researched topic are defined. The practical part of the work interprets the results of a questionnaire survey among police officers on the topic of access to the use of the reporting institute in cases of domestic violence. As it was found, the vast majority of police officers have some experience with the implementation of this institute, however, the problem for police officers is mainly the administrative burden associated with the implementation of this institute. Therefore, half of the police officers have never imposed this institute due to excessive administrative demands. It is therefore desirable to reduce this administrative burden and also to modify and update the SARA DN form to make the evaluation of cases of domestic violence clearer and more transparent.
