Transformation of foster care in the Czech Republic.

Abstract:

V práci se zaměřuji na změny v systému pěstounské péče jako samostatné instituce náhradní rodinné péče, a to po přijetí novely č. 401 z roku 2012 zákona o sociálně právní ochraně dětí 359/1999 Sb. a sledování těchto změn (transformace), které sebou nese její přijetí. Systém pěstounské péče je tvořen aktéry, typy pěstounské péče a legislativou. Cílem práce je identifikovat a popsat aktéry v procesu zprostředkování a doprovázení pěstounské péčepo přijetí novely č. 401 z roku 2012 zákona o sociálně právní ochraně dětí (359/1999 Sb.) s ohledem na další platnou legislativou zasahující do této problematiky. Aktéři, kteří určitým způsobem vystupují v procesu zprostředkování pěstounské péče, jsou samotný orgán sociálně právní ochrany dětí, doprovodné neziskové organizace a jiné instituce zprostředkující pěstounkou péči. Dále se věnuji oblasti vzdělávání pěstounů i oblasti přechodné pěstounské péče, které též souvisí se změnami v systému pěstounské péče po přijetí novely z roku 2012 a jsou klíčové k objasnění principu práce. Následné doprovázení pěstounské péče není odborné označení, ale je chápáno jako systém služeb pro pěstouny po svěření dítěte (soudem) do pěstounské péče vč. povinnosti pěstounů uzavírat dohodu o výkonu pěstounské péče. Dílčím cílem aplikační části bude metodou síťové analýzy zakreslit a popsat organizační síť aktérů vstupujících do procesu zprostředkování a následného doprovázení pěstounské péče v Ostravě po přijetí novely č. 401 z roku 2012 zákona o sociálně právní ochraně dětí (359/1999 Sb.)

Abstract:

In this work I focus on changes in system of foster care as independent institution of surrogate family care after acceptance Amendment to the Act 401 from the 2012 about social and legal protection of children (359/1999 Sb.) and observing these changes that have occurred after the acceptance of the Amendment. System of foster care is formed by participants, types of foster care and legislation. The purpose of my work is identification and description of participants in mediation process and foster care accompaniment after acceptance of the Amendment to the Act 401 from the 2012 about social and legal protection of children (359/1999 Sb.), considering other valid legislative related to this issue. Participants that act in a certain way in the process of foster care mediation are social and legal protection member itself, an accompanying non-profit organization and other institutions of foster care. Next I dedicate myself to education of foster parents and transitional foster care, which is also related to changes of foster care system after acceptance of the Amendment to the Act from the 2012 and it's the key point to clarification a principle of my work. Naming ''foster care accompaniment'' is not professional terminology but it is percepted as a service system for foster parents after they legally get a child to their custody, which is settled by court. That also includes foster parents' duty to conclude a foster care agreement. Another purpose in the application part of my work is to draw and describe by a network analysis the participants who enter the mediation process and foster care accompaniment in Ostrava after acceptance Amendment to the Act 401 from the 2012 about social and legal protection of children (359/1999 Sb.).
