Abstract:

Tato práce si klade za cíl srovnat právní úpravu obhajovacích práv obviněného ve Francii a v České republice a z toho vyplývající návrhy de lege ferenda. První kapitola se věnuje základním lidským právům v jejich kontextu k právu na obhajobu. Druhá kapitola vymezuje pojem obviněného, jak je chápán dle české právní úpravy a jak dle francouzské. Další částí práce je třetí kapitola, která popisuje základní pojmy francouzského trestního práva důležité pro pochopení celé práce. Dále navazují v jednotlivých kapitolách obhajovací práva: právo mít obhájce, právo osobní účasti na jednání, právo vyjádřit se ke všem skutečnostem, právo navrhovat důkazy, právo činit návrhy a podávat žádosti a právo podávat opravné prostředky. V závěru je provedeno srovnání obou úprav a vyzdviženy jsou zejména rozdíly mezi nimi a případné návrhy de lege ferenda

Abstract:

This work is intended to analyse firstly the legal regulations of defendant rights accused person in France and Czech Republic and arising therefrom the suggestions de lege ferenda. The first chapter recounts the fundamentals common rights in their connection to the benefit of counsel. The second chapter describes the therm accused person how it means according to the czech and french legal regulation. Next is the third chapter which explains the basics therms of the french criminal law that are important for understanding the whole work. Below in each chapter continues the defendant rights: right to counsel, right to personal participation in proceedings, right to express to all facts, right to propose to proofs, right to bring a request and right to bring legal remedy. At the close I compare the both legal regulations and I underline the differences between them and the possible suggestions de lege ferenda
