Tato práce se zabývá jednak pojmem obchodní firmy jejími funkcemi a zásadami, tvorbou a převodem, přechodem, změnou obchodní firmy a samotné meritum práce je ochrana obchodní firmy podle obchodního zákoníku. Rozebírány jsou dva typy ochrany obchodní firmy, jednak ochrana absolutní podle § 12 ObchZ a ochranu relativní podle ustanovení obchodního zákoníku o nekalé soutěži.
