Dealing with the communist past in the practice of Constitutional Court of the Czech Republic

Abstract:

Bakalářská práce se zabývá rozhodnutími Ústavního soudu České republiky, kterými přispěl do procesu vyrovnávání se s komunistickou minulostí a napravování křivd způsobených režimem. Vyrovnávání se s komunismem probíhá obecně na dvou úrovních – potrestání viníků a odškodnění obětí. Česká republika realizovala tento proces především zákony, z nichž některé byly dříve či později podrobeny kontrole Ústavního soudu České republiky. Ten k nim vydal řádná rozhodnutí, jež měla svůj podíl na procesu vyrovnávání se s komunistickou minulostí. V práci jsou nejprve analyzovány vybrané nálezy Ústavního soudu České republiky z obou zmiňovaných úrovní, po kterých následuje jejich vyhodnocení, popř. zhodnocení způsobu vyrovnávání se.

Abstract:

This bachelor thesis deals with judgements of the Constitutional Court of the Czech Republic, which took part in the process of dealing with communist past and righting the wrong caused by regime. Dealing with past basically enacts on two basic level – punishing the perpetrator and redressing the victims. In this issue enacted the Czech Republic several legal acts and some of them were sooner or later submitted by the Constitutional Court. The court’s rulings involved in the process of dealing with the communist past. At first, this thesis analyses chosen judicial acts of the Constitutional Court, then there are evaluated together with the way of dealing with the past.
