Arbitration Clauses in the Consumer Contracts

Abstract:

Diplomová práce pojednává o problematice rozhodčích doložkách ve spotřebitelských smlouvách ve světle novely zákona č. 216/1994 Sb., o rozhodčím řízení a o výkonu rozhodčích nálezů. V rámci analýzy podmínek realizace rozhodčího řízení je pozornost vedle arbitrability sporu věnována především platné dohodě stran o řešení sporu v rozhodčím řízení. Práce se dále zabývá dopadem novely na postavení stran a požadavky, které jsou kladeny na osobu rozhodce.

Abstract:

The thesis deals with the issue of arbitration clauses in consumer contracts in view of the amendment to Act No. 216/1994 Sb., of the arbitration proceedings and the enforcement of arbitration awards. Within the analysis of conditions for realization of the arbitration proceedings attention is paid to the valid agreement between the parties to resolve the dispute by arbitration, in addition to arbitrability of the dispute. The thesis focuses on the impact of the amendment on the position of the parties and the demands that are placed on the person of the arbitrator.
