The Trial of Eichmann and Its Impact on International Law Issues

Abstract:

This thesis is dedicated to one of the most commonly cited cases of the 20th century, the Eichmann trial. It is designed to be a complex analysis of the international legal aspects of the case and to highlight the impact of the Eichmann trial on the issues of extraterritorial abductions, the neutrality of courts, the core question of jurisdiction, and the defences raised in the Eichmann trial of the retroactivity of law, the effect of superior orders, the relevance of Article 6 of the Genocide convention, and the impact of the illegal kidnapping on Israel’s right to jurisdiction.

Abstract:

Táto diplomová práca sa venuje Eichmannovmu procesu, ako jednému z najznámejších procesov 20. storočia. Má za cieľ komplexne preskúmať všetky jeho medzinárodnoprávne aspekty a zdôrazniť vplyv Eichmannovho procesu na otázku nezákonných únosov, nestrannosti súdov a na kľúčovú otázku právomoci. Okrem toho sa práca zameriava aj na Eichmannove námietky vyšších rozkazov, retroaktivity práva, vplyvu únosu na právomoc súdu a článku 6 Dohovoru o zabránení a trestaní zločinu genocídy.
