Electronic Means of Evidence and their Securing

Abstract:

Diplomová práce se zabývá oblastí elektronických důkazních prostředků, problematice jejich zajišťování a jejich využitelnosti v rámci trestního řízení. V úvodu přiblíží základní technické pojmy potřebné k porozumění celého rozsahu diplomové práce, poté definuje základní aspekty zajišťování nejběžnějších elektronických důkazních prostředků včetně možného podvržení dat jako důkazu a praktického příkladu využití jako relevantního důkazu v průběhu trestního řízení. Cílem diplomové práce je zmapovat současný stav forenzní kybernetiky z hlediska využitelnosti v trestním řízení a pokusit se stanovit, zda je již plnohodnotným kriminalistickým vědním oborem.

Abstract:

The diploma thesis deals with the field of electronic means of evidence, the issues of securing them and their usability in criminal proceedings. In the introduction, he introduces the basic technical terms needed to understand the entire scope of the thesis, then defines the basic aspects of securing the most common electronic means of evidence, including the possible falsification of data as evidence and a practical example of its use as relevant evidence during criminal proceedings. The aim of the diploma thesis is to map the current state of forensic cybernetics in terms of its applicability in criminal proceedings and to try to determine whether it is already a full-fledged forensic science field.
