The Position of Municipality in the System of Social Security

Abstract:

Předkládaná diplomová práce řeší problematiku, v současné době velmi aktuální, a to změny v systému sociálního zabezpečení v souvislosti s probíhající Sociální reformou I, je zaměřena především na změny v oblasti postavení obce, jako subjektu právních vztahů sociálního zabezpečení. Nejprve je v práci popsán současný systém sociálního zabezpečení v ČR, jeho jednotlivé systémové součásti s následným vymezením subjektů státní a místní správy. Další část je věnována systému nepojistných sociálních dávek, jejich charakteristice a právnímu vymezení. Hlavní pozornost je pak zaměřena na činnost obce, pověřených obecních úřadů a úřadů obcí s rozšířenou působností v sociální oblasti, jak v přenesené, tak v samostatné působnosti, po zavedení jednotlivých kroků Sociální reformy I. V závěru práce je nastíněna problematika dopadů Sociální reformy I., jednak na celý systém nepojistných sociálních dávek a na jeho nové organizační uspořádání. Následně v návaznosti na tyto dopady, je provedeno zhodnocení účelnosti, efektivnosti změn v postavení obcí.

Abstract:

The thesis deals with the topical issue of changes in the social security system in the context of the ongoing Social reform I. It focuses on changes in the status of the municipality as a subject of legal relations of social security. First part describes the current social security system in the Czech Republic and its individual system components with subsequent determination of bodies of state and local governments. Another part is devoted to the non- insurance social benefits, their characteristics and the legal definition. The main attention is focused on the activities of municipalities, municipal authorities and responsible authorities of municipalities with extended powers in the social field as in a delegation of authority and in an autonomous authority after introducing of steps to the Social reform I. In conclusion the thesis outlines the impact of social reform issues I. Both on the system of non-insurance benefits and its new organizational structure. In response to these impacts there is and evaluation of effectiveness and efficiency changes in the status of municipalities.
