Extent of Punishment - Mitigating and Aggravating Circumstances

Abstract:

Předmětem diplomové práce je institut polehčujících a přitěžujících okolností. Práce se pokouší přehledovým způsobem podat ucelený výklad o jeho jednotlivých okolnostech, především ve vztahu k jejich interpretaci a následné aplikaci, a to jak dle úpravy současně platného a účinného zákona č. 140/1961 Sb., trestního zákona, tak i ve srovnání s nově kodifikovaným zákonem č. 40/2009 Sb., trestním zákoníkem. Samotný institut také propojuje s obecnějším institutem výměry trestu a účelu trestu. Stručně je prostor věnován úpravě institutu ve vybraných zahraničních zemí i historickému vývoji jeho úpravy v zemích českých.

Abstract:

The subject matter of the thesis lies in an extent (measurement) of punishment and mitigating and aggravating circumstances. An extent of punishment must always be only the way to fill the purpose of imposing of punishment. Mitigating and aggravating circumstances are then an institution adjusting this extent to specific circumstances of each crime and each offender. The effectual penal code contains 12 mitigating and 13 aggravating circumstances that are explicitly set up. However, the judge upon his consideration can apply other circumstances. These circumstances are entitled judicial mitigating or aggravating circumstances. The thesis also compares the new regulation with the present one. We can similarly say that the new regulation is more extensive.
