Norm diffusion in protection of reproductive rights: The case of Poland

Abstract:

Rovnost žen a mužů je spojena s řadou práv a svobod, která by se stále měla posilovat. Jednou z oblastí těchto práv jsou reprodukční práva žen. Jelikož se jedná o poměrně nově uznaná mezinárodní lidská práva, je třeba reprodukční práva více bránit a hlídat jejich dodržování. Vznik a zpracování vybraných právních předpisů k jejich ochraně probíhal na úrovni Organizace spojených národů a Evropské unie, které jsou odpovědnými aktéry šíření zavedených standard chování. Polsko je jedním ze států, které se dobrovolně zavázalo k dodržení závazků vyplývajících z těchto smluv. Nicméně je současně spíše aktérem blokujícím globální rozšíření ochrany reprodukčních práv žen a poukazujícím na nedostatečnost zvolených mechanismů šíření ze strany těchto dvou organizací.

Abstract:

Gender equality rights are connected to several rights and freedoms and still have some ways to be strengthened. One of the areas of these rights is women's reproductive rights. As this area is a relatively new component of the international rights system, women's reproductive rights need to be protected and monitored even more closely. The creation of these rights took place at the level of the United Nations and the European Union, which are the corresponding actors in the dissemination of established standards of conduct. Poland is one of the states that has voluntarily committed itself to comply with the obligations arising from these treaties. Meanwhile, it is rather an actor blocking the global expansion of women’s rights agenda and pointing out the inadequacy of the chosen dissemination mechanisms by these two organizations.
