Abstract:

Tato má práce, která nese název Funkce trestu a trestání v moderní společnosti. Filozoficko – právní analýza problému, je rozdělena do tří kapitol. První kapitola obsahuje popis trestu a jeho filozoficko právní pojetí. Zabývá se nejprve trestem jako běžnou součástí života a posléze ho rozebírá již z pohledu opatření trestního práva. Lidská (a nejen ta lidská společenství) mají již od nepaměti vyvinuté obranné mechanismy k ochraně svého fungování před jedinci, kteří ji svým deviantním chováním ohrožují. Na konci řetězce těchto obranných mechanismů stojí v moderních společnostech systém trestního práva a trestní justice. Účelem všech teorií o trestání je hledání ospravedlnění uložení trestu veřejnou mocí, neboť uložením trestu působíme osobě závažnou újmu, což je obecně vzato nemorální. Předmětem těchto teorií je tedy nalezení důvodu pro to, aby způsobení této újmy chápáno jako nemorální nebylo. Třetí část této práce se snaží reagovat na aktuální problémy naší společnosti. Vybrala jsem si problematiku mladistvých, mládeže a dětských delikventů v kontextu tématu celé práce, tedy funkce trestu a trestání, neboť v posledních letech se na naši společnost valí velké množství informací o vzrůstající kriminalitě mládeže a o nárůstu brutality činů páchaných mládeží. Navíc v poslední době došlo v naší zemi k diskuzím na téma snížení věkově hranice trestní odpovědnosti a z těchto důvodů považuji toto téma za aktuální.

Abstract:

This thesis of mine, which is named The Role of Punishment and Punishing in the Modern Society – A Philosophical and Legal Analysis of the Issue, is divided into three chapters. Chapter One describes punishment in the view of its philosophical and legal aspects. Initially, it deals with punishment as a common phenomenon of life; subsequently, punishment is analyzed from the view of criminal law. Human (as well as non-human) communities have utilized defense mechanisms to protect their function against individuals who endanger them with their deviant behavior. In modern societies, the top of the pyramid of such defense mechanisms is embodied by the system of criminal law and criminal justice. The purpose of all theories on punishing is seeking the justification of imposing punishments by public authorities, because imposing a punishment inflicts serious injury on the person concerned, which is generally considered as immoral. The subject of these theories is, therefore, finding a reason to prevent considering such an injury as immoral. Part Three responds to the current problems in our society. I have chosen the issue of juvenile and infant offenders, in the context of the whole thesis – i.e. the function of punishment and punishing, since our society has recently been being flooded up by a huge amount of information on increasing crime rate among juveniles and infants, as well as on increasing brutality of such crimes. Besides, decreasing the legal age limit of criminal responsibility has often been discussed recently, for which reason I regard this topic as significant.
