Analysis of the Basic Payment Obligations of Entrepreneurs – Natural Persons in Relation to the State Administration and the Possibility of their Unification.

Abstract:

Bakalářská práce se zabývá analýzou základních platebních povinností fyzických osob podnikajících v prostředí České republiky ve vztahu ke státní správě. Práce prezentuje souhrnný přehled povinností úhrad podnikajících fyzických osob včetně normativních úprav a správních úřadů, které jsou správou platebních povinností pověřeny. Součástí této analýzy je také identifikace potenciálních shodných principů u jednotlivých platebních povinností a případná možnost jejich harmonizace. Druhá část práce se pak zabývá již konkrétně strukturou inkasa daní a pojistného v České republice. Metoda komparativního výzkumu a metoda dedukce byly použity k prověření možnosti sjednocení povinných plateb fyzických osob daně z příjmů a plateb pojistného na sociální a na veřejné zdravotní pojištění. V kapitole jednotné inkasní místo jsou popsány zjištěné legislativní snahy o harmonizaci či sloučení určitých plateb fyzických osob ve vztahu ke státní správě. Následně jsou zde pak vyhodnocena rizika integrace plateb daní a veřejného pojistného do platby jediné. Zjištěná pozitiva i negativa jsou prezentována z pohledu správce i podnikajících fyzických osob. Současně také je zdůrazněn případný dopad na stávající legislativní úpravu platebních povinností.

Abstract:

This bachelor's thesis presents an analysis of payment obligations of natural persons doing business in the Czech environment in relation to public administration.This paper summarises payment obligations of natural persons - entrepreneurs including applicable legislation and the administrative authorities in charge of administration of payment obligations. This analysis also identifies the potential identical principles appli-cable to the individual payment obligations and the potential for their harmonization. The second part of the paper deals specifically with the structure of tax and insurance premium collection in the Czech Republic The comparative research and deduction methods were used to examine the possibility of unifying mandatory payments of personal income tax and payments of social security contributions and public health in-surance premiums.In the chapter focusing on a single collection point, there are described the identified legislative efforts to harmonize or merge cer-tain payments made by natural persons to state administration. In ad-dition, the risks of integrating tax and public insurance payments into a single payment are assessed there. The identified possible positives and negatives are presented from the perspective of the administrator and natural persons- entre-preneurs. At the same time, also the potential impact on the current legislation on payment obligations is pointed out.
