Consequences of Human Death in Private Law

Abstract:

Tato diplomová práce se zabývá následky smrti člověka v soukromém právu. Hlavní důraz je kladen na zánik právní osobnosti člověka dle občanského zákoníku, včetně vymezení pojmů smrt, důkaz smrti a domněnka smrti. Součástí práce je i vymezení kritérií smrti a přehodnocení přežívajícího dogmatu mozkové smrti. Druhá část diplomové práce je věnována dalším následkům smrti člověka. Obsahuje popis situací, kdy smrt zasáhne do různých oblastí v soukromém právu.

Abstract:

The thesis deals with the consequences of human death in the private law. The emphasis is placed on the end of a legal person in accordance with the civil code, including the definitions of death, death evidence and death assumption. The thesis also focuses on the specification of death critera and the reassessmet of cerebral death. The second part concetrates on other consequences of human death. Several situations have been described to show how death interferes into the private law.
