Responsibility of Municipality for the Performance of Government

Abstract:

KOVÁCSOVÁ, Denisa: Responsibility of municipality for the performance of government. [Bachelor thesis]. Bankovní institut vysoká škola Praha, zahraničná vysoká škola Banská Bystrica. This bachelor thesis analyses the issue of the responsibility of municipal office in public administration, in the course of exercise of public power. The aim of the following study is to point to the issues concerning the legal responsibilities of the municipal bodies. The municipal offices were established according to Slovak National Council Act No.369/1990 on Municipal Organization and later regulations. They are independent autonomous territorial bodies of Slovak Republic uniting their own permanent residents. The cities and the villages decide independently and act on their own behalf in matters connected with municipal administration and town property, if there’s no special law commending these tasks to the state or another legal body. The performance of municipal administration is done by autonomous representative bodies. The local elected representatives of the public bodies possess the same rights as every other citizen, especially concerning labour conditions, benefits and taxation, and similarly can be penalized for crimes and offenses. Liability for Damage Inflicted in the Course of Exercise of Public Power, effective as of 1st of July 2004, the public bodies are liable to compensate damage resulting from illegal decisions or actions limiting personal liberty or an incorrect administrative proceeding.

Bakalárska práca pojednáva tematiku zodpovednosti obce za výkon verejnej správy. Autorka analytickou metódou charakterizuje mnohospektrálnu, komplexnú zodpovednosť obce za výkon verejnej správy, ktorá je v súvislosti s charakterom verejnej správy ako verejnomocenskej spravovacej činnosti ponímaná ako spoločenská zodpovednosť zahŕňajúca najmä právnu, politickú, a tiež morálnu zodpovednosť. Ako osobitne dôležité druhy zodpovednosti za výkon verejnej správy rozlišujeme najmä disciplinárnu zodpovednosť, trestnoprávnu zodpovednosť a zodpovednosť za škodu spôsobenú nezákonným rozhodnutím alebo nesprávnym úradným postupom.
