Abstract:

Předkládaná práce se zabývá svobodou projevu studentů ve dvou zemích s rozličnými právními úpravami. Zatímco americká úprava má za posledních 50 let za sebou bohatý vývoj, ta česká za ní dramaticky zaostává. Hypotéza práce je stanovena tak, že studenti českých středních škol požívají větší ochrany svobody projevu než jejich američtí vrstevníci. Práce zprvu vymezuje základní rámec úpravy svobody projevu a škol. Část věnující se Spojeným státům americkým zachycuje současnou právní úpravu a formuluje nejvhodnější řešení. Naproti tomu české prostředí nenabízí příliš mnoho na výběr, a proto je nutné shromáždit veškerou stávající kusou úpravu. Pozitiva jsou vyzdvižena, negativa a nedostatečně upravená místa jsou identifikována a jejich vhodné řešení je formulováno. Ve světle těchto poznatků je kriticky posouzeno několik individuálních případů a 14 náhodně vybraných školních řádů veřejných středních škol.

Abstract:

The present thesis explores the students’ free expression rights in two countries of diverse legal backgrounds. While the U.S. model has been largely developed over the course of the last 50 years, the Czech design lags behind dramatically. The claim of the work is that students of the Czech high schools enjoy greater free expression rights than their U.S. counterparts. For these reasons, the general outlines of free expression and learning environment are introduced first. The American part examines the topical issues and endeavors to choose the most viable of existing options. In contrast, as the Czech landscape reveals no landmarks in this regard, the current patchwork regulation is first assembled to set the scene. Against this backdrop, the workable concepts are emphasized, the lacunae identified and consequently filled. The work puts these outcomes in practice and critically evaluates selected real-life controversies and fourteen randomly selected public high school rules. The end of the paper draws the conclusions and verifies the claim.
